What this business takes
This is a design-and-labour business: you sell balloon installations, event styling and staged luxury picnics to people planning birthdays, gender reveals, proposals, showers, graduations and small weddings, plus corporate and brand activations. No state licenses decorators, so the barrier to entry is almost zero and the market is crowded with hobbyists undercutting on price. The difficulty is not legal, it is operational and financial: helium and latex costs move, installs happen at night and on weekends in venues you do not control, every park and beach has its own permit rule, and the moment you serve food at a picnic you enter health-department territory.

- Decide the offer and the jurisdiction question at the same time
Before you buy a single balloon, write down which of the three lanes you are leading with: balloon installation, event styling or luxury picnics. Each has a different cost base and a different legal exposure. Balloon work brings the CPSC labelling duty if you ever package kits and the OSHA compressed gas duty once you hire. Picnics bring park permits and food permits. Styling brings the most venue-damage and insurance exposure. Then open your state's row in licensing.csv and read what that jurisdiction actually says about rental versus service, because that decides how you will invoice from day one. In a gross-receipts jurisdiction like Hawaii, New Mexico, Delaware, Washington, Guam or the Virgin Islands there is no rental-versus-service escape hatch and your pricing must absorb the tax. In Oregon, Montana, New Hampshire and Alaska there is no state sales tax at all and the local layer is what matters.
- Register the entity, the tax accounts and the local licences
Form the entity with your Secretary of State or equivalent, get the EIN, and open a business bank account before any money moves. Then work the tax registration on your licensing.csv row: a seller's permit, sales tax licence, Certificate of Authority, Registered Retail Merchant Certificate, TPT licence, GET licence, Business Registration Certificate or gross receipts registration, depending on the jurisdiction. Several states add a layer people miss: Nevada's State Business Licence, Maryland's trader's licence from the Clerk of the Circuit Court, Washington's Business Licence with city endorsements, Delaware's business licence, DC's Basic Business Licence, Philadelphia's Commercial Activity Licence, Tennessee's county and city business licence plus business tax, and Virginia's local BPOL tax. Colorado's home-rule cities each licence separately. Do the local layer in the same week, not later.
- Get the exact tax answer in writing and design your invoice around it
This is the step that separates a business from a hobby. Call the agency named on your row and ask the two specific questions: is a balloon garland that is installed and left with the customer a sale of goods rather than a rental, and is a picnic package where you set up and retrieve all furniture a taxable rental of tangible personal property? Then ask the third question that decides your margin: can separately stated delivery, setup, styling and teardown labour be excluded from the taxable amount? Log the answer, the date, the agency and the person's name in the Local requirements call sheet. Then build your invoice template with distinct line items for rental, consumables sold, labour and travel, so the tax treatment is visible on the document instead of buried in one package price. Retrofitting this after two years of bookings is how businesses end up owing back tax plus penalties.
